This Site is part of a digital network owned by the Best BBQ WNC™ Digital Assets Trust (the “Trust” or “Licensor”).
Trust Ownership: The Trust owns all brand variants, including Best BBQ WNC™ and Best BBQ Asheville™.
Entity Separation: Each site operates under a specific digital license. You acknowledge that a featured restaurant on one site has no legal affiliation, ownership, or liability for the operations of other unrelated sites in the network.
License Grant: Featured entities are granted a limited, non-exclusive license for digital presence. They hold no ownership over the domain names or the Trust's trademarks.
The Trust maintains absolute editorial control over all featured content.
Discretionary Removal: The Trust reserves the right to remove any listing, link, or review at any time, for any reason, at its sole discretion. This includes, but is not limited to, a decline in a restaurant's food quality, poor customer service ratings, or any action that may disparage the Best BBQ WNC™ brand.
Immediate De-Listing: While a 30-day notice is standard for administrative changes, the Trust reserves the right to immediately de-list or remove any entity that fails to maintain the Trust's Quality Benchmarks or violates local health safety standards.
No Vested Interest: Payment for a "Featured Listing" does not create a permanent right to be listed or a "Star Rating." The Trust remains an independent arbiter of quality.
All rankings, reviews, and "Editor's Choice" designations are based on the Trust's proprietary editorial opinion.
Subjectivity: Rankings reflect personal preferences regarding smoking techniques and meat quality. They are not a scientific survey or public poll.
Independence: The Trust and its sites are independent editorial guides and are not affiliated with Mountain Xpress or the "Best of WNC" poll.
In the event of any dispute, claim, or controversy arising out of or relating to any site in the Trust’s network, you agree to first provide the Trust with written notice and a period of thirty (30) days to correct, cure, or otherwise address the issue. No legal action or formal complaint may be initiated until this 30-day "Opportunity to Cure" period has expired.
Maximum Liability Cap: To the maximum extent permitted by North Carolina law, the total aggregate liability of the Trust and its affiliates for any claim—whether in contract, tort, or otherwise—is limited to the sum of $100.00 USD.
Indemnification: You agree to indemnify the Trust from any claims arising from your use of the sites or your violation of these Terms.
Liability is strictly confined to the specific entity providing the service:
Restaurant Operations: For sites featuring a specific restaurant (e.g., Big J's Bubba-Q), that restaurant is solely responsible for food production, health safety, and service.
Directory Operations: For directory sites (e.g., Best BBQ Asheville™), the Trust acts only as a marketing platform. The Trust does not prepare food and is not liable for any third-party restaurant's performance.
No Cross-Liability: A claim arising from one specific restaurant or site cannot be extended to the Trust’s other unrelated digital assets or entities.
SMS/Text Authorization: By providing your mobile number, you authorize the specific restaurant or site to send text messages regarding orders or quotes. Reply "STOP" to opt-out.
NC Privacy Rights: Under the North Carolina Consumer Privacy Act (NCCPA), we do not sell your personal data.
Disclosure: Sites may contain links to various affiliates. We may receive a small commission at no additional cost to you.

Venue: These Terms are governed by the laws of the State of North Carolina. Any legal proceedings shall be held in the state or federal courts serving Henderson County, NC.
Attorney’s Fees: In the event of any litigation or formal dispute arising from these Terms or the use of the Sites, the prevailing party shall be entitled to recover its reasonable attorney’s fees and all court costs from the non-prevailing party.
Severability: If any part of these Terms is found to be unenforceable, the remaining sections shall remain in full force and effect.
