Master Privacy Policy

Effective Date: March 15, 2026

This Privacy Policy describes how the Best BBQ WNC™ digital network (collectively, the “Sites”) collects, uses, and shares your information. This policy is governed by the laws of the State of North Carolina and applicable federal regulations.

1. Ownership and Data Responsibility

This network is a collaborative digital platform involving separate legal entities:

  • Infrastructure Ownership: All domains, technical infrastructure, and brand trademarks are owned by the Best BBQ WNC™ Digital Assets Trust (the “Trust” or “Licensor”).

  • Operational Separation: Data collected on a site dedicated to a specific featured partner (e.g., a restaurant-specific domain) may be managed and used by that specific partner for order fulfillment and customer service.

  • Joint Use: By submitting your information on any site in our network, you acknowledge that your data is processed independently by the featured entity for their business operations and by the Trust for editorial, infrastructure, and marketing purposes. The Trust is a marketing platform and is not liable for the data handling practices of individual featured entities.

2. Information We Collect

In compliance with the North Carolina Consumer Privacy Act (NCCPA), we disclose the following categories of collection:

  • Contact Information: Name, email, phone number, and physical address (collected via catering or contact forms).

  • Order & Interest Data: Information regarding your BBQ preferences and catering needs.

  • Electronic Identifiers: IP addresses, cookies, and pixels used for site performance, security, and affiliate tracking.

  • Consent Records: Documentation of your agreement to our Master Terms of Service under the E-SIGN Act.

3. SMS and Text Messaging (TCPA & NCCPA Compliance)

If you provide your mobile number, you are providing "prior express written consent" to receive automated marketing and informational text messages from the Trust or its featured partners.

  • Non-Condition of Purchase: Consent is not a condition of purchase.

  • Opt-Out: Reply STOP to any message to revoke consent immediately.

  • Data Privacy: We do not sell or share mobile numbers with third-party lead generators. Your number is used specifically for updates, order status, and brand promotions.

4. Email Marketing (CAN-SPAM Act)

We comply with the CAN-SPAM Act. All marketing emails will:

  • Identify the sender clearly.

  • Include a visible "Unsubscribe" link.

  • Honor opt-out requests within 10 business days.

5. Affiliate & Third-Party Tracking Disclosure

Our Sites may participate in affiliate marketing programs.

  • Tracking Cookies: When you click an affiliate link, a cookie is placed in your browser to track the sale for attribution purposes. These are governed by the third-party's privacy policy.

  • Pixel Tracking: We use pixels to track the effectiveness of our marketing and "Editor's Choice" recommendations.

6. Data Sharing and "No Sale" Policy

We do not sell your personal data. We share information only with:

  • Service Providers: Vendors who assist with email delivery, SMS processing, or website hosting.

  • Featured Partners: The specific restaurants or vendors you choose to interact with through our Sites.

  • Legal Compliance: If required by North Carolina or Federal law.

7. Your North Carolina Privacy Rights (2026)

Under the NCCPA, North Carolina residents have the following rights:

  • Right to Know: You may request a disclosure of what data we collect.

  • Right to Delete: You may request that we delete your personal information.

  • Right to Correct: You may request that we fix inaccuracies in your data.

  • Exercise of Rights: To exercise these rights, please contact us at the email below. We will respond within 45 days.

8. Intellectual Property & Brand Separation

Data collection does not imply brand ownership. All data is used under a license agreement where the Best BBQ WNC™ Digital Assets Trust retains all rights to the domain and trademarks, and featured partners retain rights to their original content and restaurant-specific assets.
